Now, therefore, His Excellency the Governor, with the advice of the Executive Council, in pursuance of the powers in him by the said Act, doth hereby pro- claim and set apart as a new locality, and also fix the name thereof as the Kichmond Road District, the area thereof front until and the East and in Schedule, 1910. WHEREAS by "The Government Railways Amend- ment Act, 1907," it is provided that the Governor may from time to time by Order in Council published in the Government Gazette, declare that any Railway, or por- tion thereof, shall be a District Railway: And whereas it is desirable that the portion hereinafter set out of Railway shall be declared a District Railway: Now, therefore, His Excellency the Governor, with the advice and with the advice and consent of the Execu- tive Council, doth hereby declare that the portion of the way from Mount Magnet to Sandstone, a distance of about one chain, so far as to the existing structures, shall be a District Railway. WHEREAS by Section 23 of "The Land Act, 1908," it is made lawful for the Governor to grant the Council of any Municipality and Board of any Road District, the control of any Municipality, Lands Board, or Road District, to make any Order in Council, but not to empower such Board to make, repeal and alter by Laws for the control and management of such reserves, and prescribe fees for improving thereon and for other matters, such by-laws to be subject to the approval just published in the Government Gazette: And whereas it is deemed advisable that the reserve for a term of the Measuring should be placed under the control of the Municipality of Northam, so far as it is placed to the control of Management: Now, therefore, His Excellency the Governor, by with the advice and consent of the Executive Council, doth hereby order that the served hereinby under the control of the Engineering Office of the City of Subiaco for the purposes of public Management, and that Licence such Board to make, repeal or alter by-laws for the control and management of the said Reserve, for prescribing fees for improving thereon and for other, but not so as to allow such by-laws to be imposed, paid, collected, and disposed of and to enforce the observance thereof by such penalties as they attach through and 28 a day a continuing breach, but not more than £20 for any one offence.
